DodoHost — Terms of Service & Service Agreement

1. Acceptance

By creating an account, activating a service, or purchasing a subscription with DodoHost, you agree to these Terms of Service and Service Agreement (the "Agreement"). If you do not agree, do not use DodoHost services.

2. Scope of Service

DodoHost provides managed infrastructure hosting (including CPU, RAM, storage, and network connectivity). We act as a resource provider. We do not own or sell third-party applications or server software that Customers deploy on the Service unless specifically stated.

All physical hosting hardware is located within Australia unless otherwise stated on the product page.

All payments are processed using our chosen payment processor. By paying you agree to the payment processor's terms and policies.

Currency: Unless otherwise specified, all prices are listed in AUD.

No Refunds: DodoHost maintains a no-refund policy for routine charges. Notwithstanding this policy, nothing in this Agreement is intended to exclude, restrict or modify any guarantees, remedies or rights that are conferred on consumers by law, including the Australian Consumer Law, which may provide remedies where a service fails to meet consumer guarantees.

Customers are responsible for maintaining accurate billing details and for any payment method fees or chargebacks.

5. Free Plan Policy

DodoHost offers a Free Plan, and we may terminate, suspend or limit services for Free Plan customers at any time and without prior notice where necessary to preserve platform stability, security, or economics of the service.

Free Plan customers agree that features, support levels, and availability may change at DodoHost's discretion.

6. Uptime Guarantee & Downtime Compensation

DodoHost strives for reliable operations. For paid subscribers, in the event of an outage caused solely by DodoHost's infrastructure, we will provide compensation as described below.

7. Acceptable Use Policy

You must not use DodoHost services for illegal activities, to host malware, or to facilitate activities that harm other users or the infrastructure. DodoHost reserves the right to suspend activity that violates local laws or threatens the integrity of our network.

Detailed acceptable use rules may be published in a separate Acceptable Use Policy (AUP).

8. Limitation of Liability

To the maximum extent permitted by law, DodoHost provides the Service on an "as-is" and "as-available" basis and excludes all warranties not expressly set out in this Agreement.

DodoHost is not liable for indirect or consequential loss, loss of profits, loss of data (including game worlds or configuration files), or loss resulting from changes to third-party software that make hosting impossible.

Where liability cannot be excluded by applicable law, DodoHost's total aggregate liability for any claim shall not exceed the total payments received from the Customer for the Service in the thirty (30) days preceding the claim.

9. Indemnity

You agree to indemnify and hold harmless DodoHost, its officers, employees, and contractors from any claim, demand, loss or damage (including reasonable legal fees) arising out of your use of the Service, breach of this Agreement, or infringement of third-party rights.

10. Termination

We may suspend or terminate accounts that breach this Agreement, engage in illegal activity, or threaten the security or reputation of DodoHost. Termination may be immediate for severe breaches. You may terminate your account by following the procedures in your account dashboard.

Upon termination, DodoHost may delete Customer data after a defined retention period.

12. Privacy & Data Protection

DodoHost's privacy practices are set out in our Privacy Policy. Customers are responsible for protecting any personal data they store on the Service and must comply with applicable data protection laws.

If you process personal data of others, you are responsible for any legal obligations that arise from that processing.
